Simmies Golf Terms of Service

These Terms of Service govern your use of Simmies Golf Co.'s services, including the Simmies app, the website, and any Simmies Golf simulator facility. By creating an account, making a booking, or entering any Simmies facility, you agree to these Terms.

If you do not agree to these Terms, do not use Simmies services.

1. About Simmies

Simmies Golf Co. operates unmanned indoor golf simulator facilities in Illinois. Facilities use uniform hardware and a flat hourly price of $30 per hour across every bay and every hour. Access is automated through the Simmies app, smart-lock entry system, and remote monitoring.

2. Eligibility

  • You must be at least 18 years old and able to enter a binding agreement.
  • You must provide accurate registration information, including valid contact and emergency-contact details.
  • You must not be prohibited from using Simmies services under applicable law or a prior suspension.

Minors may be present only when accompanied by and under direct supervision of the booking owner, who must be 21 or older. See the Guest Policy.

3. Your Account

  • One account per individual. Sharing accounts, credentials, or access codes is prohibited.
  • You are responsible for all activity under your account, bookings, payments, conduct, and guests.
  • Credential sharing is grounds for suspension or termination without refund.
  • You must keep account information current, especially phone and emergency-contact details.

4. Bookings, Payments, and Refunds

Bookings

  • All bookings are made through the Simmies app or website.
  • Bookings are prepaid through Stripe, Inc.
  • Each booking includes a bay, start time, and duration.
  • Your facility access window opens and closes with your booked time.

Pricing

$30 per hour, flat, across every bay and every hour. No peak pricing, bay-tier pricing, or surge pricing.

Rescheduling and refunds

Rescheduling and refunds are governed by the Cancellation & Rescheduling Policy.

5. Facility Access

Door access is controlled by the Simmies smart-lock system. Do not share your session code or unlock credentials with anyone not on your booking. Attempting to enter outside your window, remain after your window, prop doors, or defeat access controls may result in account termination and criminal prosecution where appropriate.

6. Facility Rules and Conduct

You and your guests agree to:

  • Follow posted rules, on-screen instructions, and app-based guidance.
  • Use simulator equipment only for its intended purpose.
  • Report equipment damage, malfunction, or facility issues immediately.
  • Keep the bay clean and remove belongings at the end of the session.
  • Vacate promptly at the end of your booked time.

Prohibited conduct includes smoking, vaping, intoxicated use, credential sharing, unauthorized guests, unsafe equipment use, and any conduct that violates these Terms or applicable law.

7. Unsupervised Facility Acknowledgment

Simmies facilities operate without on-site staff. Access is automated, emergency assistance may be delayed, the support number is for operational issues, and you are responsible for your own safety. Facility use is conditioned on accepting the Release & Waiver of Liability.

8. Communications

By creating an account, you consent to transactional email or SMS messages for bookings, access codes, refunds, account security, and safety notices. Marketing communications are optional.

9. Intellectual Property

The Simmies name, logo, app, website, and related materials are owned by Simmies Golf Co. You may not copy, modify, redistribute, or commercially exploit them without written consent.

10. User Content and Recordings

You may record your own session within your booked bay for personal or non-commercial use, subject to the Release & Waiver of Liability. Simmies security footage is handled as described in the Privacy Policy.

11. Electronic Records and Signatures

Electronic agreements, notices, disclosures, and signatures satisfy any legal requirement that they be in writing.

12. Limitation of Liability

To the fullest extent permitted by Illinois law, Simmies Golf Co. and its released parties are not liable for indirect, incidental, special, consequential, or punitive damages arising from Simmies services. Simmies' aggregate liability shall not exceed the greater of amounts paid in the 12 months before the claim or $100. This does not limit liability that cannot be limited by law.

13. Termination

Simmies may suspend or terminate access for violations of these Terms, the waiver, cancellation policy, guest policy, privacy policy, suspected fraud, repeated no-shows, unsafe behavior, or other protective reasons.

14. Dispute Resolution

Before bringing a legal claim, you agree to contact disputes@simmiesgolf.com and attempt informal resolution for at least 30 days. If unresolved, disputes shall be resolved through binding individual arbitration administered by JAMS or AAA, except where prohibited by law. Proceedings are individual, not class, consolidated, or representative actions.

15. Governing Law

These Terms are governed by Illinois law. Subject to dispute resolution terms, litigation shall be brought exclusively in the state or federal courts located in the Illinois county where the facility in question is located.

16. Changes to These Terms

Material changes will be posted on the Terms page and active account holders will be notified by email at least 30 days before changes take effect.

17. Entire Agreement

These Terms, together with the Release & Waiver, Privacy Policy, Cancellation & Rescheduling Policy, and Guest Policy, constitute the entire agreement between you and Simmies.

18. Severability

If any provision is unenforceable, the remaining provisions remain in full force.
